Terms of Service

1. What Rudia is

Rudia (“Rudia”, “we”, “us”) operates rudia.co and its merchant subdomains, a platform connecting independent merchants in Kenya (“merchants”) with buyers who want scheduled, repeat delivery of consumable goods such as water, cooking gas, dairy and groceries (“buyers”). Rudia is a technology platform and payment facilitator. Each store on Rudia is operated by an independent merchant, not by Rudia, and the contract of sale for any order is between the buyer and that merchant.

2. Accounts

You need a phone number to create a Rudia account. You are responsible for keeping your account secure and for everything that happens under it. Tell us immediately if you believe your account has been accessed without your permission.

3. Orders and subscriptions

• Every order and subscription charge on Rudia is paid by M-Pesa, and every charge requires your own PIN approval. Rudia never charges you without that approval.
• A subscription renews on the schedule you choose. You can pause, skip a delivery, or cancel at any time from your account, subject to each store’s cutoff windows shown at checkout.
• Delivery is provided by the merchant directly, or by a courier the merchant arranges. Rudia does not itself operate delivery vehicles or riders.

4. Fees

Rudia charges merchants a commission on each sale, disclosed to the merchant before their store goes live. Rudia also charges buyers a service fee of 10% of the merchant’s price. The service fee is already included in every price you see on Rudia, from the product page to checkout, so the total shown before you pay is the total you pay, together with any delivery fee. There is no further fee added at payment. The service fee is refunded in proportion whenever the items it was charged on are refunded. A subscription keeps the service fee rate it was created with.

5. Refunds and cancellations

Refunds and cancellations for orders are governed by our Refund & Cancellation Policy, which forms part of these Terms.

6. Prohibited use

Certain product categories cannot be sold on Rudia at all, and certain conduct is not allowed on the platform. See our Acceptable Use Policy.

7. Liability

Rudia is not a party to the sale between a buyer and a merchant, and is not liable for the quality, safety, or legality of what a merchant sells, except to the extent Rudia’s own payment or notification systems fail. Nothing in these Terms limits liability where the law does not allow it.

8. Changes

We may update these Terms as the product changes. Material changes will be announced by email or in-app notification before they take effect.

9. Governing law

These Terms are governed by the laws of the Republic of Kenya.
